The following terms and conditions apply to all website and software development services provided by Skyware Technology Limited to the client. Please read these terms and conditions carefully, as any purchase or use of our services implies that you have read and accepted our terms and conditions.

Commencement of Work
Payment of the initial deposit will be considered an acceptance of the contract for work.

Timeframes
To remain efficient we must ensure that work we have programmed is carried out at the scheduled time. This is why we ask that you provide all the required information in advance, so we would be able to be in sync with the milestones detailed in any of our project.

Additional expenses
Client agrees to reimburse Skyware Technology Limited for any additional expenses necessary for the completion of the work. Examples would be custom photography, content creation, purchases of special fonts or stock photography etc.

Training & Support
Upon delivery, Skyware Technology Limited will organise a training session with anyone who needs to use the website or software. During the session, all participants will learn how to manage the application, update pages, upload content and make any basic changes to the application or website.

Domain Names & Hosting
Note that Skyware Technology Limited does not offer hosting ourselves, but we do host with third parties. While the third party is chosen based on a trusting and successful relationship in the past, Skyware Technology Limited is not responsible for any shortcomings or errors that may occur on the part of the third parties.
Skyware Technology Limited may purchase domain names on behalf of the client and our client must obey all the conditions of service applicable with our hosting partners. Most of our relaible Hosting companies includes- Hostgator , Bluehost and Godaddy .
Payment and renewal of these domain names is the responsibility of the client. The loss, cancellation or otherwise of the domain brought about by non or late payment is not the responsibility of Skyware Technology Limited. The client should have a record of the due dates of payment to ensure that payment is received in good time.

Ownership
The client will gain the total ownership of the finished, software, assembled web pages, templates, graphics, logos, branding, artwork, marketing copy, source code and instructional material produced by Skyware Technology Limited

Browsers
Skyware Technology Limited makes every effort to ensure websites and web apllication are designed to be viewed by the majority of visitors. Websites are designed to work with the most popular current browsers (Google Chrome, Firefox, Internet Explorer 8 & 9). Client agrees that Skyware Technology Limited cannot guarantee correct functionality with all browser software across different operating systems. Skyware Technology Limited cannot accept responsibility for web pages which do not display acceptably in new version of browsers released after the website have been designed and handled over to the client. As such, Skyware Technology Limited reserves the right to quote for any work involved in in changing the website design or code for it to work with updated browser software.

Third Party Providers
Skyware Technology Limited may offer certain third party products and services example the web hosting, and third party software. Such products and services may be subject to the terms and conditions of the third party provider. Discounts, promotions and special third party offers may be subject to additional restrictions and limitations by the third party provider. You should confirm the terms of any purchase and the use of goods or services with the specific third party provider with whom you are dealing.

Liability & Warranty
Skyware Technology Limited liability will be limited to the cost of supply for this work. Skyware Technology Limited is not responsible for any indirect losses your data and content. Once a client has agreed to a look and feel proof and instructed Skyware Technology Limited to proceed to develop, any subsequent changes in style or design requested by the client will be charged for at the appropriate hourly rate. We offer a 3months post-launch bug fixing warranty at no charge.

Termination of contract
The contracting party will not have the right to cancel any contract after the project has commenced. If, after commencing a project, the contracting party decide not to continue with project development, then the contracting party is obliged to pay the total amount of work that has been completed up to the day of cancellation based on Skyware Technology Limited hourly rate.

Governing Law
This agreement shall be governed by and construed in all respects in accordance with the Laws of country.
